Terms of Service

The rules for using DealsBanana. By using the service, you agree to these terms.

1. Acceptance

By accessing dealsbanana.com, creating an account, or claiming a coupon, you agree to these Terms of Service ("Terms") and our Privacy Policy. If you don't agree, don't use the service.

2. Who can use DealsBanana

• You must be at least 18 years old to create an account and claim coupons
• You must provide accurate registration information
• You're responsible for activity on your account
• One person, one account — no impersonation

3. The service

DealsBanana is a marketplace connecting diners with independent food businesses ("vendors") — restaurants, sweet shops, cafés, bakeries, and more — through coupons. We do not prepare, cook, or serve food ourselves; we host coupon listings and facilitate communication between diners and vendors. Coupons are claimed online and redeemed in person at the vendor's location.

For diners

• You can browse coupons, claim them, leave reviews
• Coupons are redeemed in person at the restaurant; the in-store purchase is between you and the vendor
• Each coupon's specific terms (validity, exclusions, redemption window) are shown on the coupon

For vendors

• You're responsible for food safety, accuracy of your coupon listings, and honoring claimed coupons
• You agree to honor the coupon terms and availability shown on your listing
• You agree to the subscription plan as described in your onboarding agreement
• You must comply with all applicable health, food safety, and tax laws

4. Payments and fees

• Vendor subscription payments are processed by Stripe
• Subscription plans and fees as set out in Pricing
• Refunds governed by Refund Policy

5. Reviews and content

• You may post reviews only for coupons you actually claimed and redeemed
• Reviews must be honest, lawful, and respectful
• You retain ownership of content you post but grant DealsBanana a worldwide, royalty-free license to display, reproduce, and distribute it on our platform
• We may remove content that violates these terms or our Community Guidelines without notice

6. Prohibited use

You may not:

• Use the service for unlawful purposes
• Reverse-engineer, scrape, or systematically extract data from our site without permission
• Attempt to bypass authentication, rate limiting, or security controls
• Submit fake reviews or manipulate ratings
• Impersonate another person, business, or DealsBanana itself
• Use the service to harass, threaten, or harm others

7. Intellectual property

All DealsBanana branding, designs, code, and content (excluding user-generated content) are owned by Manviga LLC or its licensors. You may not copy, distribute, or create derivative works without permission.

8. Disclaimers

DealsBanana is provided "as is." We don't warrant that the service will be uninterrupted, error-free, or that any specific vendor will honor any specific coupon. Food preparation, allergens, and freshness are the vendor's responsibility — please contact the restaurant directly for specific dietary or allergy questions.

9. Limitation of liability

To the maximum extent permitted by law, DealsBanana's total liability for any claim arising from your use of the service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

10. Indemnification

You agree to indemnify and hold DealsBanana harmless from claims arising out of your use of the service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

You can close your account at any time via Settings or by messaging us through the contact form. We may suspend or terminate accounts that violate these Terms, with or without notice depending on severity.

12. Disputes and governing law

These Terms are governed by the laws of the State of Texas. Any dispute must be resolved through binding arbitration in Dallas County, Texas under the American Arbitration Association's Consumer Arbitration Rules, except for claims that may be brought in small claims court. Class actions are waived.

13. Changes

We may update these Terms. Material changes are emailed to active users 30 days in advance. Continued use after the effective date constitutes acceptance.
